These Terms of Service (“Terms”) govern your access to and participation in The Amistara, a membership-based relationship-building platform operated by Amistara LLC, a SCWB Media platform (“Company,” “we,” “our,” or “us”).
By accessing, joining, purchasing a membership, participating in events, or otherwise engaging with The Amistara, you acknowledge that you have read, understood, and agree to be bound by these Terms.
Purpose of The Amistara
The Amistara exists to provide thoughtfully designed experiences, conversations, events, workshops, and digital spaces intended to help members build meaningful connections and experience a greater sense of belonging.
While The Amistara is designed to facilitate opportunities for connection, participation, and relationship-building, we do not guarantee friendships, romantic relationships, networking opportunities, business opportunities, emotional outcomes, personal growth outcomes, or any specific member experience.
Participation in The Amistara is voluntary. Each member remains solely responsible for their own decisions, actions, communications, boundaries, and interactions both within and outside the platform.
Eligibility
By joining The Amistara, you represent and warrant that you are at least eighteen (18) years of age and have the legal capacity to enter into this Agreement.
You further agree to provide accurate information when creating your account and to maintain the security of your login credentials.
Memberships, fees, and payments
Membership fees, subscription plans, billing schedules, and pricing are displayed at the time of purchase and may be modified by the Company from time to time.
Unless otherwise stated in writing, memberships automatically renew until canceled by the member.
Members are responsible for maintaining valid payment information.
Except where required by law, membership fees are non-refundable. Failure to use membership benefits, attend events, participate in discussions, or engage with platform offerings shall not entitle a member to a refund.
Member conduct
The Amistara exists to be a welcoming, inclusive, and safe neighborhood for queer people around the world. Every member plays a role in creating that experience.
By participating in The Amistara, you agree to treat fellow neighbors with kindness, respect, and integrity.
The following conduct is prohibited:
- Harassment, discrimination, hate speech, bullying, threats, intimidation, stalking, coercion, abusive behavior, or repeated unwanted contact.
- Using The Amistara to monitor, track, gather information about, intimidate, or facilitate unwanted contact with another member (“neighbor”).
- Sharing another member’s personal information, travel plans, accommodations, location, contact information, photos, or other identifying details without their explicit consent.
- Creating fake, duplicate, or anonymous accounts to evade moderation, conceal your identity, impersonate another person, or misrepresent yourself.
- Impersonation, fraud, deception, catfishing, or any other form of misrepresentation.
- Solicitation, spam, unauthorized promotions, scams, phishing attempts, or deceptive business practices.
- Pressuring, manipulating, coercing, or attempting to isolate another member from the community.
- Encouraging or coordinating harassment.
- Sharing screenshots, private conversations, or member content outside the community without permission, except when necessary to report safety concerns.
- Disruptive behavior that interferes with conversations, events, clubs, or the overall member experience.
- Retaliation against anyone who reports a concern or participates in a community safety review.
- Any activity that violates applicable local, state, federal, or international law.
Community safety
If you experience or witness behavior that violates these guidelines, please report it to the moderation team through The Amistara Team. Reports will be handled as confidentially as possible and reviewed fairly.
To protect the safety and trust of our neighborhood, The Amistara reserves the right to investigate reported conduct and, at our sole discretion, issue warnings, remove content, suspend, or permanently revoke memberships when these guidelines or our Terms are violated.
Our goal is not simply to enforce rules. It is to preserve a community where every neighbor can show up authentically, build meaningful friendships, and feel safe doing so.
Off-platform interactions
Members understand that relationships formed through The Amistara may extend beyond the platform.
Any communication, meetup, travel, collaboration, business arrangement, romantic relationship, friendship, or interaction occurring outside of Company-operated spaces is solely the responsibility of the individuals involved.
The Company does not conduct background checks, verify identities, investigate members, or guarantee the conduct, intentions, or safety of any participant.
Events and experiences
Participation in virtual or in-person events is voluntary.
Members assume all risks associated with participation in any event, gathering, meetup, workshop, retreat, or experience.
The Company reserves the right to modify, postpone, cancel, or reschedule events at its discretion.
Additional event-specific waivers may be required.
Intellectual property
All content, branding, graphics, logos, materials, recordings, videos, event formats, workshops, resources, and platform materials are owned by Amistara LLC and protected by applicable intellectual property laws.
Members may not reproduce, distribute, sell, record, copy, modify, or commercially exploit Company content without prior written permission.
Member-created content
By posting content, testimonials, comments, photos, messages, or other materials within The Amistara, members grant the Company a non-exclusive, worldwide, royalty-free license to display, reproduce, distribute, and use that content as reasonably necessary to operate, moderate, secure, promote, or improve the platform, subject to our Privacy Policy and applicable law.
Members retain ownership of their original content and represent that they have the rights necessary to share it.
Media and event photography
The Amistara may photograph, film, livestream, or record portions of virtual and in-person events, meetups, workshops, discussions, and other community activities. When photography or recording is planned, we will provide notice before or during the event and request consent where required.
Participation in promotional photography or recording is optional. With permission, the Company may use a participant’s name, image, likeness, voice, comments, testimonial, or participation on The Amistara website, social media accounts, email communications, press materials, advertisements, and other educational, editorial, documentary, community, or promotional materials.
Members and guests may tell the event team that they do not wish to be photographed or recorded. Requests to remove identifiable media from channels controlled by The Amistara, or to stop its future use, may be submitted to info@scwbmedia.com or The Amistara Team through the app.
We will review removal requests promptly and make reasonable efforts to remove approved content from channels under our control and discontinue future use. Removal may not be possible for materials already printed, distributed, independently reposted by third parties, or retained in secure backups until they are overwritten in the ordinary course. Additional consent or a separate release may be requested where appropriate. Please review our Privacy Policy for more information.
Right of removal
The Company reserves the right, in its sole discretion, to suspend, restrict, deny, or terminate any membership at any time, with or without notice.
Reasons may include violations of these Terms, Community Guidelines, safety concerns, disruptive conduct, reputational concerns, misuse of the platform, or any conduct the Company reasonably believes is inconsistent with the mission and well-being of The Amistara.
Disclaimer of warranties
The Amistara is provided on an “as-is” and “as-available” basis.
The Company makes no warranties regarding uninterrupted access, member compatibility, outcomes, opportunities, relationships, business results, personal development results, or any specific benefit derived from participation.
Limitation of liability
To the fullest extent permitted by law, Amistara LLC, its owners, employees, volunteers, moderators, contractors, affiliates, and representatives shall not be liable for any indirect, incidental, consequential, special, emotional, reputational, financial, or other damages arising from participation in The Amistara.
Indemnification
Members agree to indemnify and hold harmless the Company from any claims, damages, losses, liabilities, costs, or expenses arising from their conduct, participation, misuse of the platform, violation of these Terms, or interactions with other members.
Governing law
These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee.
Dispute resolution
The parties agree to attempt to resolve disputes informally before pursuing litigation. The Company reserves the right to require mediation or binding arbitration where permitted by law.
Changes to these Terms
The Company may modify these Terms at any time. Continued participation following any update constitutes acceptance of the revised Terms.
The Amistara reserves the right, at its sole discretion, to deny, suspend, or terminate any membership when we determine it is necessary to protect the safety, privacy, well-being, or overall experience of the community or its members.
